Acceptable Use Policy

Effective date: January 1, 2026  ·  Last updated: June 1, 2026

This Acceptable Use Policy ("AUP") governs how Merchants and authorized users may use the SecondSwype platform. Violations may result in immediate suspension or termination of access.

1. Permitted Use

You may use SecondSwype solely to:

  • Recover legitimate soft-declined transactions from genuine cardholders who have authorized the original transaction.
  • Analyze payment routing performance through the provided dashboard.
  • Integrate the SecondSwype API into your authorized checkout flow.

2. Prohibited Activities

You must not use SecondSwype to:

  • Process transactions for prohibited merchant categories (as defined by card networks).
  • Attempt to recover transactions that were declined for fraud, AML, or sanctions screening reasons.
  • Circumvent card network rules, issuer decisions, or regulatory requirements.
  • Probe, scan, or test vulnerabilities in the SecondSwype platform or infrastructure.
  • Introduce malicious code, viruses, or interfere with platform operations.
  • Resell, sublicense, or provide third-party access to the SecondSwype API without written authorization.
  • Use the platform in a way that could damage SecondSwype's relationships with payment networks or banking partners.

3. Compliance with Card Network Rules

Merchants must comply with Visa, Mastercard, and applicable network rules at all times. SecondSwype's recovery routing operates within network retry guidelines. Merchants are responsible for ensuring their use of the Service does not constitute excessive retrying or velocity abuse as defined by applicable network rules.

4. Enforcement

SecondSwype reserves the right to monitor usage patterns for compliance with this AUP. Upon detecting a violation, SecondSwype may:

  • Immediately suspend access to the platform.
  • Terminate the Merchant Agreement with written notice.
  • Report violations to relevant authorities, card networks, or banking partners as required by law.

5. Reporting Violations

To report suspected AUP violations or security concerns, contact security@secondswype.com. Reports are treated confidentially.
